This thesis discusses the Impact of Free Visa Policy for Chinese Citizens (PRC) on the Emergence of Illegal Labor (Study In West Kalimantan). The approach method used in this research is yurids-normative approach. From the results of this thesis research, it is concluded that Factors that become the background so that the occurrence of increasing the number of foreign workers, especially those from China to foreign workers who are in West Kalimantan Province comes from China. The factors causing the increase in the number of foreign workers, especially those from China to Indonesia spread in West Kalimantan is the number of equipment origin of China used in West Kalimantan, Local Workers need assistance tools, cheap equipment from China, the lack of knowledge Local labor in science and technology. Impact of visa-free granting policy for Chinese citizens against the Emergence of Illegal Workers Under Presidential Regulation No. 21 of 2016 on Visa Free Visits In West Kalimantan there are positive impacts and negative impacts. The positive impact is first to Increase Original Regional Income (PAD) Kota / Kabupaten in West Kalimantan Province, which comes from local taxes and user charges. Then Increase the Welfare of Community Life in West Kalimantan Province that can be reviewed from the amount of PAD and PMDN in the City / District in West Kalimantan Province.After that increased motivation in the quality of work. The next impact is the Transfer of Science and Technology. Then the negative impact is the decrease of Local Employment Opportunities, this section will be divided into the Role of Government in West Kalimantan Province in overcoming the many unemployment caused by the Foreign Workers of China (PRC).And the last is labor as a soft diplomacy tool of China. Measures that should be taken by the government to protect local workers from invading foreign workers from China To anticipate the impact of freedom in the world of employment, in particular the use of Foreign Workers (TKA), the government must establish legislation regulating the supervision of Foreign Workers (TKA). The role of the government to protect local workers from invading foreign workers from China. In West Kalimantan alone, it is hoped that it can increase the supervision of foreign workers in West Kalimantan in the framework of the protection of domestic workers as a consequence of the invasion of foreign workers from China. The supervision of Foreign Workers (TKA) may be in the form of inspection of Permit for Employment of Foreign Workers (IMTA) for each Foreign Worker (TKA) used by the company concerned, the type of job inspection or position and examination of the presence or absence of counterpart labor. While the obstacles in Foreign Workers (TKA) control in West Kalimantan are: the lack of Employee Supervisor (PPK), and the lack of budgetary funding for Foreign Workers (TKA) supervision. This certainly makes it difficult for KDP to monitor foreign workers (TKA). To overcome these problems, the government should increase the number of KDP and the amount of budget in the supervision of Foreign Workers (TKA). That way, the supervision of Foreign Workers (TKA) can be improved.
